Please read these Terms of Service ("Terms") carefully before using the DumpThings website and directory service operated by DumpThings ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. We will indicate changes by updating the "Last updated" date. Your continued use of the Service after any modification constitutes your acceptance of the revised Terms.

1. Description of Service

DumpThings is an online directory that connects individuals and businesses seeking dump trailer rentals with local rental companies. The Service allows:

  • Visitors to search for and view dump trailer rental listings
  • Visitors to submit quote requests directly to rental companies
  • Rental business owners to create, claim, and manage listings

DumpThings is a directory and lead generation platform only. We are not a rental company, broker, or party to any rental agreement between a visitor and a listed business. All rental transactions, pricing, availability, and agreements are solely between the customer and the rental company.

2. Eligibility

You must be at least 18 years of age to use the Service or create an account. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. User Accounts

Account Registration

Rental business owners may register for an account to claim or submit listings. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.

Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, the Service, or third parties, or for any other reason at our sole discretion.

4. Listing Submissions and Claims

Accuracy of Information

If you submit or claim a listing, you represent and warrant that all information you provide is accurate, complete, and not misleading. This includes but is not limited to business name, address, phone number, trailer sizes, pricing, availability, and service area.

Approval Process

All listing submissions and claim requests are subject to review and approval by DumpThings. We reserve the right to reject, modify, or remove any listing at our sole discretion without notice or liability. Submission of a listing does not guarantee publication.

Ongoing Accuracy

You are responsible for keeping your listing information current and accurate. If your business closes, changes locations, or ceases to offer the services listed, you must update or request removal of your listing promptly.

Prohibited Listings

You may not submit listings that:

  • Misrepresent your business, services, or pricing
  • Infringe on the intellectual property rights of others
  • Contain false, misleading, or deceptive information
  • Duplicate an existing listing for the same business location
  • Advertise services that are illegal in the applicable jurisdiction

5. Quote Requests

When a visitor submits a quote request through a listing, their contact and project information is forwarded directly to the rental company associated with that listing. DumpThings acts solely as a conduit for this communication and is not a party to any resulting rental transaction.

DumpThings does not guarantee that a rental company will respond to any quote request, that the requested equipment will be available, or that any specific pricing will be honored. All terms of rental, including pricing, availability, deposits, cancellation policies, and liability, are determined solely by the rental company.

By submitting a quote request, you consent to your contact information being shared with the applicable rental company for the purpose of responding to your inquiry.

6. Prohibited Conduct

You agree not to use the Service to:

  • Submit false, fraudulent, or misleading information in any form
  • Scrape, crawl, or systematically extract data from the Service without our written consent
  • Submit spam, unsolicited communications, or fake quote requests
  • Impersonate any person, business, or entity
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Post or transmit any content that is defamatory, obscene, harassing, or otherwise objectionable
  • Reverse engineer, decompile, or attempt to extract the source code of any part of the Service

7. Intellectual Property

Our Content

The Service and its original content, features, and functionality — including but not limited to text, graphics, logos, icons, and software — are owned by DumpThings and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our express written permission.

Your Content

By submitting content to the Service (including listing information, photos, and descriptions), you grant DumpThings a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content in connection with operating and promoting the Service. You represent that you own or have the necessary rights to grant this license.

8. Third-Party Links and Services

The Service may contain links to third-party websites or services, including rental company websites. These links are provided for convenience only. DumpThings does not endorse, control, or assume responsibility for the content, privacy practices, or conduct of any third-party site or service. You access third-party sites at your own risk.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY LISTING INFORMATION, PRICING, OR AVAILABILITY DISPLAYED ON THE SERVICE. LISTING INFORMATION IS PROVIDED BY THIRD-PARTY RENTAL BUSINESSES AND MAY NOT BE CURRENT OR ACCURATE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DUMPTHINGS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

DUMPTHINGS IS NOT RESPONSIBLE FOR ANY RENTAL TRANSACTIONS, DISPUTES, DAMAGES, INJURIES, OR LOSSES ARISING FROM YOUR INTERACTION WITH ANY RENTAL COMPANY LISTED ON THE SERVICE. ALL RENTAL AGREEMENTS ARE SOLELY BETWEEN YOU AND THE RENTAL COMPANY.

11. Indemnification

You agree to indemnify, defend, and hold harmless DumpThings and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, your submission of inaccurate listing information, or your violation of any rights of another person or entity.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class action or representative proceeding.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination — including intellectual property, disclaimers, indemnification, and limitations of liability — shall survive.

14. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DumpThings regarding the Service and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
